Secretary of State for the Colonies telegraphed on the 25th

October 1901 that the War Office had consented to waive this

condition.

Condition VIII. "The Dock Company will not

erect any building or chimney which will mask the fire of the

Kowloon fast Battery."

This condition was agreed to by the Dock Company

on the 28th June 1901.

Four special conditions were imposed by the Colo-

nial Scvernment viz:-

(1) "The expense of forming a new cable reserve

and shifting the existing cables thereto to be borne by the purchaser." This condition was accepted by the Cock Company on the 9th June 1902. It was made by the Colonial Government in view of the Acting Director of Fublic Works report of the 19th

September 1900 above referred to.

(2) "The purchaser to resume and hand over to the

Government free of cost a strip of land 50 feet in width adjoin- ing and to the East of Gillies Avenue and extending from the

harbour to Eulkeley Street."

(3) "The entire area to be reclaimed and levelled

off to such levels as the Director of Public Works may approve and protected by a substantial sea-wall, or otherwise, to the

satisfaction of the Director of Public Works."

(4) "Such reclamation to be completed within years of date of sale and a sum of not less than $50,000 over and above the cost of such reclamation to be expended on rate- able improvements within 5 years of the date of sale."
